If Powerball is "America's Game", than what is Mega Millions?
"America's Game" doesn't seem to be a trademark of Powerball but I could be wrong. It probably is just a marketing slogan like when Pepsi was "The Choice of a New Generation". Mega Millions would come off sounding too unoriginal and probably face a lawsuit if they were suddenly to start using it as well. Besides Mega Millions only comprises 11 states where as Powerball is made up of 27 states (over half the union) plus the District of Columbia and U.S. Virgin Islands. So Powerball being "America's Game" is more nearer the truth.

Actually, I believe they DID trademark the phrase "America's Game". If another lottery attempted to use that phrase, they would be violating the trademark.
powerball has the trademark of "america's game". they also have the patent on the multi-state game, so i'm guessing mega millions is paying the MUSL quite a bit of money. the MUSL should have patented the game style as well. that way, mega millions wouldn't be able to use the same game style.
