Charges dismissed against mother in lottery ticket scheme

STORM LAKE, Iowa — Charges have been dismissed against one of three people charged with fraudulently claiming a lottery ticket prize.

District Judge David Lester on Monday dismissed a charge of aiding and abetting theft of a lottery ticket or share against Sally Bosler. His ruling came after an oral motion from the state requesting the dismissal because, prosecutors said, insufficient evidence now exists to convict Bosler.

Bosler, 42, her daughter Ashley Bosler and Ashley Bosler's boyfriend, Johnny Long Jr., all of Sioux Rapids, Iowa, were arrested July 27. Long had attempted to claim the $250,000 prize from an Iowa Lottery instant-scratch game ticket at the Storm Lake Regional Lottery office on June 17. The ticket raised suspicions, and state and local authorities launched an investigation.

Ashley Bosler, 21, who was an employee at a Casey's general store, is accused of scratching off a corner of the lottery ticket and scanning the bar code that confirmed it was a winner.

She did not buy the ticket and was 20 years old at the time, not old enough to play the lottery, authorities said, so she asked Long to claim the prize.

Ashley Bosler is charged in Buena Vista County District Court with theft of a lottery ticket or share and aiding and abetting theft of a lottery ticket or share. She is scheduled to stand trial Nov. 15.

Long, 26, is charged with theft of a lottery ticket or share and is scheduled to enter a plea on Nov. 7.

 If the State does not have enough evidence to prosecute then dismissal is the only choice left. Saves the tax- payers money. Smiley

Maybe, but there is evidence on the other two individuals.  Although, from the beginning locking up her merely trusting mother, I thought, was rather cruel (she'll probably never recover from those anxieties).

And how has that changed since the day they arrested her without any evidence that she had committed a crime?

Considering that the mother was charged based on an allegation that she brought the daughter $20 to pay for the ticket I don't see how the prosecution can present an argument that the ticket was stolen, so the charges of theft probably should be. Whether they can prove the daughter stole it or not I haven't seen anything offering a theory about how the boyfriend was involved in the alleged theft. Charges related to buying the ticket when you're too young and then having somebody else claim it are a different matter.

Had a feeling the prosecutor was going to dismiss the charges on the mother as it was a long shot to begin with. They will grasp at straws in order to get anything to stick.

Not they haven't gone to court yet but the evidence doesn't look for them.
