Video Lottery Placed On South Dakota Ballot

Video lottery is once again on the chopping block in South Dakota.

The state Supreme Court says voters can decide the fate of the controversial gambling devices in November.

A unanimous ruling from the high court today also adds a measure to the statewide ballot that seeks to repeal a state tax on cell phones.

State officials had refused to put those issues on the ballot even though the people pushing them gathered enough signatures to qualify for slots on the ballot.

In a nutshell, the attorney general cited a 1995 state Supreme Court decision that said measures initiated in petition campaigns cannot be used to repeal existing laws.

Today's high court ruling overturns that earlier decision.
